To purchase from Vitaria or create an account, you may be asked to provide your name, email address, billing and shipping information, and payment details. You represent and warrant that all information you provide is accurate, current, and complete.

You are solely responsible for maintaining the security and confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info@vitariasupplements.shop if you become aware of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or are used for fraudulent purposes.

You represent and warrant that: (i) you have the legal right to use the payment method provided; (ii) all purchase information you submit is true and accurate; and (iii) your purchases are for personal or household use and not for commercial resale or export. We reserve the right to cancel orders where fraud or unauthorised transactions are suspected.

All returns and refunds are governed exclusively by our Refund Policy, which is incorporated into these Terms by reference.

Prices, Billing & Promotions

Prices are subject to change without notice. The price charged for a product will be the price displayed at the time your order is placed, as confirmed in your order confirmation email. Prices do not include applicable taxes unless expressly stated.

In the event of a conflict between promotional terms and these Terms, the promotional terms will govern for the duration of the promotion. We reserve the right to correct pricing errors at any time, including after an order has been placed.

Shipping & Delivery

All shipping is governed by our Shipping Policy, which is incorporated into these Terms by reference. Delivery timeframes are estimates only and are not guaranteed. Once your order is transferred to a carrier, risk of loss passes to you. We are not liable for delays caused by carriers, customs processing, or events outside our reasonable control.

We reserve the right to remove Feedback that is unlawful, offensive, misleading, or otherwise in violation of these Terms. You are solely responsible for the accuracy of any Feedback you submit.

Disclaimer of Warranties

The Services and all products offered through the Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. Some jurisdictions do not allow the exclusion of implied warranties, so this disclaimer may not apply to you in full.

Section XII
Arbitration Agreement & Class Action Waiver

By using our Services, you agree that any dispute, claim, or controversy arising from or relating to these Terms or your use of the Services will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, rather than in court.

You and Vitaria each waive the right to a jury trial and the right to participate in any class action or representative proceeding. Arbitration will be conducted on an individual basis only. This will preclude you from bringing any class, collective, or representative action against Vitaria, and also preclude you from participating in or recovering relief under any current or future class, collective, consolidated, or representative action brought against Vitaria by someone else.

However, either party retains the right to bring individual claims in small claims court to seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights, including actual or threatened infringement, misappropriation or violation of a party’s copyright rights, trademarks, trade secrets, patents or other intellectual property rights.


The parties agree that the arbitrator (“Arbitrator”), and not any federal, state, or local court or agency, shall have exclusive authority to resolve any disputes relating to the interpretation, applicability, enforceability or formation of this Arbitration Agreement, including any claim that all or any part of this Arbitration Agreement is void or voidable. The Arbitrator shall also be responsible for determining all threshold arbitrability issues, including issues relating to whether the Terms are unconscionable or illusory and any defense to arbitration, including waiver, delay, laches, or estoppel.

If you are a new user and wish to opt out of this arbitration agreement, you must send a written opt-out notice postmarked within 30 days of first accepting these Terms to: info@vitariasupplements.shop. Your notice must include your full name, address, and signature. Opting out does not affect any other part of these Terms.

Section XIII
Limitation of Liability

To the fullest extent permitted by applicable law, Vitaria, its founders, officers, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages including lost profits, lost data, or personal injury arising from your use of the Services or any products purchased through the Services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim shall not exceed the amount you paid to Vitaria in the 90 days preceding the claim. Nothing in this section limits liability that cannot be excluded under applicable law, including consumer protection statutes.

Indemnification

You agree to indemnify, defend, and hold harmless Vitaria and its founders, officers, employees, affiliates, and service providers from and against any losses, damages, liabilities, claims, or expenses including reasonable attorneys' fees arising from: (a) your breach of these Terms; (b) your violation of any applicable law; or (c) your use of or access to the Services.

Section XV
Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Texas.

Section XVI
Severability & Entire Agreement

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining Terms will continue in full force. These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Vitaria and supersede all prior agreements or understandings relating to the Services.

Section XVII
Changes to These Terms

We reserve the right to update or modify these Terms at any time. If changes are material, we will provide at least 30 days notice before the new terms take effect, either by email or by a prominent notice on our website. Your continued use of the Services after any changes take effect constitutes your acceptance of the revised Terms. You can review the most current version of these Terms at any time on this page.
